Fullscreen Lightbox Pro plug-ins
The following agreement regarding any of the Fullscreen Lightbox Pro plug-ins (such as Vanilla JavaScript Fullscreen Lightbox Pro or React Fullscreen Lightbox Pro)—referred to as "software"—and the licenses required to use them is made between Bantha Apps Piotr Zdziarski—referred to as "licensor"—and anyone who is installing, accessing, or in any other way using the software, or holding a license.
The author and holder of the copyright of the software is Piotr Zdziarski. The licensor and as such issuer of the licenses and bearer of the worldwide exclusive rights including the rights to reproduce, distribute, and make the software available to the public in any form is Bantha Apps Piotr Zdziarski, Stefana Starzyńskiego 8/54, 99-400 Łowicz, Poland.
A license is a legal immaterial construct and may be primarily deemed as a circumscribed hereunder permission to use the software.
The software is provided "as is" and without warranties or representations of any kind (express, implied or statutory, including but not limited to the warranties of title and noninfrigement and the implied warranties of merchantibility and fitness for a particular purpose), all of which the author and licensor disclaim to the fullest extent permitted by law. You use of the software is at your sole risk.
To the extent permitted by applicable law, in no event shall the author or licensor be liable for any damages (including, without limitation, consequential, special, incidental, indirect, or similar damages, personal injury (including death), loss of profits, corruption or loss of data, business interruption, or any other damages or losses) arising out of or in connection with the use or performance of the software, or shall the liability of the licensor exceed a sum equal to the fees paid by you hereunder.
Paragraph X. You may use the software not holding a license if the software is incorporated in a project furnished to you by a person holding a license or a person allowed to use the software, provided that you haven't conveyed that project to that person earlier (directly or indirectly), but you are not allowed to (1) extract the software, (2) license, sublicense, lease, or lend the project, (3) redistribute or resell the project, (4) transfer the project to more than one person, or (5) significantly alter the project.
You may not redistribute or resell the software or licenses.
You may not license, sublicense, lease, or lend the software or licenses.
All Fullscreen Lightbox licenses that you've purchased may be, in its entirety, transferred to one individual or entity (depending on your specific license's rights) provided that you stop using the software and licenses in any form (including but not limited holding a copy of the software, using the software on any website, or keeping an access to the Fullscreen Lightbox account) and that the recipient agrees to the terms of this agreement. You may not transfer the licenses to more than one person.
A license gives you the permission to use the software in retail projects (such as sale of front-end themes including the software or making a website for someone) provided that the end user accepts this agreement and especially the Paragraph X.
You are not required to attribute or link to the licensor in any of your projects. But consider doing it if you are using it in a retail project; for example, if you are making a website for a client, consider informing the client that he is not allowed to, among others, significantly alter the website (whereas after such alterations the software would still be used on the website) by himself unless he purchases a license (you may alter the website on his behalf as you wish if you've purchased a license).
Within the limits of applicable law, we reserve the right to review and change this agreement at any time. As long as you are using the software or licenses, you are responsible for regularly reviewing this agreement. Continued use of the software or licenses after such changes are performed shall constitute your consent to them.
The agreement shall be governed by the laws of the Republic of Poland.
Individual License
The license allows the software to be used only by one person, excluding legal entities, but including sole proprietorships without employees.
Team & Company License
The license allows the software to be used by a legal entity without its subsidiaries or a sole proprietorship with employees.
