The Services are provided exclusively to individuals who are at least 13 years old. Accounts registered by bots or automated methods are not authorized and will be terminated.
Terms of Service
These terms of service went into effect on December 9, 2022.
By using the fslightbox.com website, creating an account on the website, or making use of the Fullscreen Lightbox plug-ins (collectively, the "Services"), you agree to be bound by the following terms of service (the "Terms"). The Services are operated by Bantha Apps Piotr Zdziarski ("we," "us," or "Fullscreen Lightbox").
If you agree to these Terms on behalf of a company or another legal entity, you represent that you have the authority to bind such entity, its affiliates, and all users who access the Services through your account to these Terms.
No Unlawful or Prohibited Use
You will not use the Services for any purpose that is unlawful or prohibited by these terms.
You may not use the Services in any manner that could damage, disable, overburden, or impair Fullscreen Lightbox's servers.
You may not attempt to gain unauthorized access to the Services, especially the Pro versions of the Fullscreen Lightbox plug-ins.
You may not attempt to reproduce, resell, rent, license, or create derivative works from the website or the Pro versions of the Fullscreen Lightbox plug-ins.
You may not attempt change, alter, or modify this website or these Terms.
Limited Warranties and Liability
The Services are provided "as is" and without warranties or represantations of any kind (express, implied or statutory, including but not limited to the warranties of title and noninfrigement and the implied warranties of merchantibility and fitness for a particular purpose), all of which Fullscreen Lightbox disclaim to the fullest extent permitted by law. Your use of the Services is at your sole risk.
To the extent permitted under applicable law, in no event shall Fullscreen Lightbox be liable for any damages (including, without limitation, consequential, special, incidental, indirect, or similar damages, personal injury (including death), loss of profits, corruption or loss of data, business interruption, or any other commercial damages or losses) arising out of or in connection with the use or performance of the Services, or shall the liability of Fullscreen Lightbox exceed a sum equal to the fees paid by you hereunder.
Fullscreen Lightbox does not claim ownership, endorse, or take responsibility for any third-party products that may be incorporated in the Services, or information about which may displayed in the Services.
Indemnification
You hereby agree to indemnify and hold Fullscreen Lightbox, its directors, officers, predecessors, successors in interest, employees, agents, suppliers, and licensors harmless from and against any and all third-party claims of liability, losses, damages and costs, including, without limitation, reasonable attorneys' or legal fees, arising out of or in connection with your violation of these Terms, and your use of or inability to use any of the Services.
Privacy
Our Privacy Policy explains the way we handle and protect your data and privacy in relation to the use of the Services. By agreeing to the present Terms and to be able to use the Services, you also agree to our Privacy Policy.
Terms of Payment
The Pro versions of the Fullscreen Lightbox plug-ins are generally non-refundable and any refunds will be at the sole discretion of Fullscreen Lightbox.
The sales are processed by the Bright Market LLC (d/b/a FastSpring) merchant of record, including the management of taxes, so if you want to provide a VAT ID (to, for example, use the reverse charge system of the European Union), you have to provide it to FastSpring. The invoices are issued by FastSpring and should be provided to you in the email after the purchase.
Modification to the Terms
Within the limits of applicable law, we reserve the right to review and change these Terms at any time. As long as you are using the Services, you are responsible for regularly reviewing these Terms. Continued use of the Services after such changes are performed shall constitute your consent to them.
Applicable Law and Language
These Terms shall be governed by the laws of the Republic of Poland. In case of discrepancy between the English version of these Terms and any translated version, the English version shall prevail.
